Proposed Regulations for New Shoreham
Motor Vehicles for Hire

The Town Council has scheduled a public hearing to consider adopting Motor Vehicle for Hire Regulations, pursuant to Sec. 8-161(c)(1) of the New Shoreham Code of Ordinances, which states the Motor Vehicles for Hire Commission is responsible for drafting and forwarding regulations for the operation of motor vehicles for hire in the town in keeping with public convenience and necessity, including rates for the hiring of such motor vehicles to the town council for its approval.
The Motor Vehicles for Hire Commission submits the following proposed regulations:
MVFH Regulation: Pets
Chauffeurs may not bring their pets to work, except for licensed service animals.  Fares’ pets may be carried at the discretion of the chauffeur, except licensed service animals must be carried.   
MVFH Regulation: Advertising on motor vehicles for hire
No advertising may appear on or in motor vehicles for hire. For purposes of this regulation, information identifying the motor vehicle for hire is not considered to be advertising.
MVFH Regulation: Dress code
All chauffeurs must adhere to the following minimum professional standard of dress:
Pants/Skirts- clean, no holes, rips or tears. Hems must be sewn.
Shorts - clean, no holes, rips or tears. Length must be equivalent to “Bermuda Short” type. No fringed bottoms; hems must be sewn.
Shirts - clean, with long or short sleeves, no holes, rips or tears; no cut offs; tucked neatly into pants if the shirt has tails. If a square bottom, shirt may be left out. No halter tops. Sweatshirts may be worn only as outer garment.
Shoes - sneakers, loafers or docksiders are acceptable with no holes or tears. Sandals may be worn if secured around the ankle and the heel.  
Jackets - clean, no holes or rips.
Caps/Hats - clean, no holes, worn on the top of the head and with the brim facing forward.
Grooming - clean clothes, hair must be neat and combed, face must be clean shaven or beard and/or mustaches must be neat and trimmed.
MVFH Regulation: Violations of the ordinances
A violation of an ordinance pertaining to a motor vehicle for hire is a violation of the Motor Vehicle for Hire Commission regulations.
On Monday, December 2, 2013 at 7:00 p.m. the Town Council will hold a public hearing at Town Hall, Old Town Road, Block Island, at which time all persons for or against may be heard and the Town Council may act on the regulations and/or amendments hereto..

Proposed Amendment to New Shoreham’s Revised Ordinances
Motor Vehicles for Hire

The Town Council has scheduled a public hearing to consider changes to the Town’s General Ordinances Chapter 8 Licenses and Business Regulations, Article VII Motor Vehicles for Hire Section 163 “Total number of licenses; transfer; renewal; eligibility.”  The proposed deletions are crossed out (like this) and additions appear in underlined (like this).
Sec. 8-163. - Total number of licenses; transfer; renewal; eligibility.
(a)    The total number of licenses under this article shall be as follows:
(1)    34 32 taxicab licenses.
(2)    Two limousine licenses.
(3)    Two charter bus licenses.
The town council may, by majority vote, increase or decrease the number of licenses in any and all categories.
In the event that the town council votes to decrease the number of licenses in any category or in the event that this ordinance is amended to reduce the number of licenses in any category, such reduction shall be implemented by attrition and not by cancelling a license held by any individual. For purposes of this paragraph, attrition means the death of a license holder (unless the deceased license holder’s spouse applies for the cancelled license as provided in paragraph (b) of this Sec. 8-163), the revocation of a license, and/or the failure of a license holder to renew a license.
(b)    Upon the death of a licensee, the license shall be canceled. Within 30 days after the death of a licensee, his or her license shall become available to the next qualified applicant, provided, however, that if the decedent’s legally married spouse applies for the cancelled license within 30 days of the death of the licensee, the spouse, if qualified, shall be entitled to receive the license, notwithstanding that the spouse may not have had a Rhode Island operator’s license or chauffeur’s license with a New Shoreham address at least five years prior to the date of application.
(b)    Upon the death of a licensee, the license shall be canceled. Except as provided in paragraph (a), within 30 days after the death of a licensee, his or her license shall become available to the next qualified applicant, provided, however, that if the decedent’s legally married spouse applies for the cancelled license within 30 days of the death of the licensee, the spouse, if qualified, shall be entitled to receive the license, notwithstanding that the spouse may not have had a Rhode Island operator’s license or chauffeur’s license with a New Shoreham address at least five years prior to the date of application.
(c)    Only natural persons shall be eligible for licenses granted under this article. No license shall be granted to a corporation, partnership, or other business entity. No person shall hold more than one license in any one category. No married couple shall hold more than one license in any one category. Licenses shall be nontransferable.
(d)    All licenses shall be issued for a one-year period beginning on May 15 of each year. Applications for renewals of licenses shall be received by the town clerk by April 15 of each year. Any existing licenses not renewed by the town council prior to May 15 of each year, and not issued by the town clerk in exchange for receipt of the required fee prior to June 30 of each year, shall become available to the next qualified applicant on the list maintained by the commission.
(e)    Each license shall be for one vehicle only.
On Monday, December 2, 2013 at 7:00 p.m. the Town Council will hold a public hearing at Town Hall, Old Town Road, Block Island, at which time all persons for or against may be heard and the Town Council may act on this proposal and/or amendments hereto.
