New Shoreham Town Council
The New Shoreham Town Council’s Public Hearing on the Capital Improvement Ordinance is continued to Tuesday, January 19, 2022 at 7:00 p.m. at the Town Hall, 16 Old Town Road, Block Island, at which time all persons for or against may be heard and the Town Council may act on this proposal and/or amendments hereto. Copies of the proposed amendments to Sections 2-241 through 2-245 in their entirety were
published in the November 27 edition of the Block Island Times and may be seen at the Island Free Library, Town Hall, and on the Town’s website (new-shoreham.com).

The New Shoreham Town Council will consider amendments to the Zoning Ordinance related to Living Floor Area, as follows. Deletions appear crossed out and additions are underlined. The proposed language may be altered or amended prior to the close of the public hearing without further advertising, as a result of further study or because of the views expressed at the public hearing. Any alteration or amendment must be presented for comment in the course of the hearing.
Section 202 Definitions
Add two new definitions:
Hawking And Peddling: Hawking means to sell or to offer for sale any goods, wares, or merchandise, including any food or beverage, on any public street, highway, or public right of way from a stationary location. Peddling means selling or offering for sale any goods, wares, or merchandise from a vehicle, cart, or any other conveyance that is not stationary. Notwithstanding the above, Hawking and Peddling do not include activities conducted by Mobile Food Establishments required to be registered pursuant to Title 5, Chapter 11.1 of the Rhode Island General Laws.
Mobile Food Establishment: A food service operation that is operated from a movable motor driven or propelled vehicle, portable structure, or watercraft that can change location. It specifically includes, but is not limited to, food trucks, food carts, ice-cream trucks/carts, and lemonade trucks/carts.
Section 306D (Permitted Uses In RA Zone)
Add Hawking and Peddling and Mobile Food Establishments as permitted uses in the RA Zoning District, but only as follows:
Hawking and Peddling pursuant to a license duly issued by the Town Council pursuant to Chapter 8, Article V, Section 8 for a location that is open to the public and established by the Town Council under said Chapter 8, and which activity is in compliance with the provisions of Title 5, Chapter 11 of the Rhode Island General Laws.
Mobile Food Establishment pursuant to a duly issued license issued by the Town Council pursuant to Chapter 8, Article V, Section 8 for a location that is open to the public and established by the Town Council under said Chapter 8, and which activity is in compliance with the provisions of Title 5, Chapter 11.1 of the Rhode Island General Laws.
